Vic Park Race Track rally Competition

Terms & conditions

  1. The “Synergy Race Track Rally Competition” competition (the Competition) is a trade promotion lottery run by Electricity Generation and Retail Corporation (trading as Synergy) (ABN 58 673 830 106) (Synergy) on and subject to these terms and conditions. To the maximum extent permitted by law, Synergy’s decision is final and no correspondence will be entered into in relation to any dispute or other matter arising in relation to the Competition.
  2. The Competition commences at 2pm (WST) on Sunday 19 November 2017 and closes at 9pm (WST) on Sunday 19 November 2017 (Competition Period).
  3. Nothing in these terms and conditions excludes, restricts or modifies the rights of any person or entity as a “consumer” under the Australian Consumer Law (or any other statutory rights) to the extent the law does not allow them to be excluded, restricted or modified. 
  4. All entries will be the property of Synergy. The information entrants provide will be used by Synergy for the purpose of and relating to conducting the Competition and otherwise in accordance with Synergy’s Privacy Policy and Collection of Information Statement (available at synergy.net.au). Without limitation, Synergy may disclose entrants’ personal information to relevant suppliers, contractors and agents for or in relation to any of those purposes and to State and Territory regulatory bodies and winners’ names may be published, as required, under the relevant legislation and as set out in these terms and conditions. Synergy’s marketing activities are subject to the Australian Privacy Principles in the Privacy Act 1988 (Cth).
  5. Synergy in its sole discretion may cancel, terminate, modify or suspend the Competition, or invalidate any affected entries, subject to the approval of Gaming and Wagering Commission (WA) or other relevant authorities, if required.
  6. These terms and conditions are governed by and to be interpreted in accordance with the laws of Western Australia.
    Eligibility
  7. To enter the Competition, you must, during the Competition Period, visit the Synergy Race Track Rally stand at the Vic Park Summer Street Party and ride a bicycle that is part of the Synergy Race Track Rally. Each bicycle will power a race car which is mounted on a mini race track in-built on the Synergy Race Track Rally. The entrant will compete with three other contestants (four competitors will compete at one time). 
  8. To be eligible to enter the Competition entrants must a named Synergy residential account holder prior to the commencement of the Competition or the child of a named Synergy residential account (Eligible Entrant).
  9. Eligible Entrants under the age of 18 years old must have parental or guardian consent to enter the Competition.
  10. Synergy and the organisers of the Vic Park Summer Street Party reserve the right to refuse entry to the Competition where Synergy or the Vic Park Summer Street Party event organisers consider it necessary to do so for health or safety reasons.  
  11. Each Eligible Entrant is only permitted to submit one entry in the main prize draw. 
  12. Employees of, and contractors engaged by, Synergy, including their immediate families, are ineligible to enter.
  13. By entering and participating in the Competition, Eligible Entrants agree to hold harmless, defend and indemnify Synergy from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of or related to the entrant’s participation in the Competition and riding the bicycles which are part of the Synergy Race Track Rally.
  14. Synergy accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or ineligible entries, applications, claims or correspondence whether due to error, omission, alteration, tampering, theft, deletion, destruction, transmission, interruption, communications failure or otherwise.  Synergy has no control over the postal system, internet, telecommunications networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.

    The Competition mechanic
  15. The Competition mechanic:
    There are four mini race cars on the track at one time (identified by unique colours)
    Four Eligible Entrants will compete at any one time in a race. Each contestant will mount a fixed bicycle and pedal. The energy generated by each contestant from the pedalling, will power the mini race car to move along the race track. 
    The contestants are required to complete four laps of the track.
    The Eligible Entrant with the first car to cross the finish line in each race will receive an entry in the main prize draw to win $300 off their next electricity bill.
    The race car that crosses the line first in each race will be recorded on screen and judged and determined by a representative of Synergy. The decision of Synergy's representative is final and no correspondence will be entered into regarding Synergy's decision.  
  16. Eligible Entrants must exercise due care and skill when mounting and riding the bicycles part of the Synergy Race Track Rally and are responsible for their own safety when participating in the Competition. 
  17. If for any reason any aspect of the Competition is not capable of running as planned, including by reason of infection by computer virus, telecommunications networks failure, bugs tampering, unauthorised intervention, fraud, technical failures, or any cause beyond the control of Synergy which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, Synergy reserves the right to cancel, terminate, modify or suspend the Competition. 

    Receiving the prize
  18. The total prize pool of the Competition is $300 (GST inc).  The prize will be awarded to one Eligible Entrant who receives an entry in the main prize draw following participant in a race. 
  19. The winner will be drawn by random selection at around 12pm (WST) on Wednesday 22 November 2017 at Synergy’s office at 219 St George Terrace, Perth WA 6000.  
  20. The winner will receive a $300 (GST inc) credit on their Synergy residential electricity account or the Synergy residential electricity account of their parent or guardian in the case of an Eligible Entrant who is under the age of 18 years old.  The winner will receive bill(s) in credit until the full value of the prize has been reached.  For the avoidance of doubt, the credit cannot be redeemed for cash.
  21. Individuals are only eligible to win one prize which will be the first prize drawn for that winner. 
  22. The winner will be notified by email and / or telephone on or around 22 November 2017. 
  23. The winner will forfeit the major prize if the winner does not respond to confirm acceptance of the prize within 24 hours from being notified by Synergy that they have won the prize.
  24. The prize must be taken "as offered" and cannot be transferred, exchanged or redeemed for cash. If the stated prize is unavailable for any reason, Synergy reserves the right to offer a substitute prize of equivalent value or specification or both.
  25. Any additional products or services not included in the prize, but required by a winner, will need to be arranged and paid for by that winner.
  26. The winner consents to cooperating with Synergy and Synergy using his or her name and image in any media for promotional purposes related to the Competition including on Facebook and Twitter.  Synergy has the right to use such publicity materials in any medium and in any reasonable manner it sees fit.
  27. None of Synergy and its associated agencies and companies are liable to any winner or any other person in any way (including but not limited to liability for negligence) for any loss, expense, damage, injury (including personal injury or injury to property) or death which is suffered or sustained (whether or not arising from any negligence) in connection with all or any of the promotion, riding a bicycle that is part of the Synergy Race Track Rally, the Competition or acceptance, transportation, delivery or use of the prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum liability allowable by law).
  28. Any queries or complaints regarding the prize and its terms must be directed to Synergy.
