Terms and Conditions - ACT Year 2 – Win a weekend away at Quay West Resort Bunker Bay

1. Synergy’s (ABN 71 743 446 839) decision is final and no correspondence will be entered into.
2. To be eligible to enter, you must be 18 years of age or over and Synergy must receive your signed and completed Expression of Interest form for Year 2 of the Air Conditioning Trial by 4 pm on 02 January, 2012.
3. Employees, relatives and agents of Synergy, Western Power, Perth Solar City and any related bodies are not eligible to enter.
4. The competition for ‘a family weekend at Quay West Resort Bunker Bay’ commences on 4 August, 2011 and closes at 4 pm on 02 January, 2012.
5. The winner will be drawn by random electronic selection at 12 pm on 9 March, 2012 at the Perth Solar City Consortium Office, 363 Wellington Street, Perth WA 6000.
6. Entrants must have a qualifying air conditioner that meets all requirements for participation in the Perth Solar City Air Conditioning Trial (ACT). Evaporative air conditioners are not eligible to take part in the trial and therefore participants with Evaporative systems need not complete the Expression of Interest form.
7. Synergy will automatically enter all eligible and qualifying ‘participant’ details into the draw.
8. The winner will be notified by mail and/or telephone.
9. The total prize pool value is $2000 (including GST) and consists of a family weekend break at Quay West Resort Bunker Bay for 4 people for 2 nights, plus a voucher for the restaurant to be used over the course of the stay and spending money.
10. The prize must be taken “as offered” and cannot be varied or extended or transferred or exchanged for cash.
11. Any additional products or services not included in the prize, but required by the winner, will need to be arranged and paid for by the winner.
12. The competition winner consents to Synergy using his or her name, suburb and photograph for publicity purposes.
13. Synergy is not liable for any loss, damage or injury arising out of, or in any way connected with this promotion and/or the prize.
14. Synergy accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or ineligible applications, claims or correspondence whether due to error, omission, alteration, tampering, theft, deletion, destruction, transmission, interruption, communications failure or otherwise. Synergy has no control over the internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.
15. If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs tampering, unauthorised intervention, fraud, technical failures, or any cause beyond the control of Synergy which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, Synergy in its sole discretion may cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of gaming authorities.
16. Synergy and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
17. All entries will be the property of Synergy. The information entrants provide will be used by Synergy for the purpose of conducting this promotion. Synergy may disclose entrants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants and to State and Territory lottery departments and winners’ names may be published as required under the relevant legislation. Synergy’s marketing activities are subject to the national Privacy Principles in the Privacy Act 1988.
18. Synergy reserves the right to change the duration of the promotion at any time.
