Terms and conditions - Synergy Life Hoyts double movie passes for a year

1. The ‘Win 10 Hoyts Double Movie passes for a Year’ competition (the Competition) is a trade promotion lottery run by Synergy’s (ABN 71 743 446 839) upon and subject to these terms and conditions. To the maximum extent permitted by law, Synergy’s decision is final and no correspondence will be entered into in relation to any dispute or other matter arising in relation to the Competition.

2. To be eligible to enter the Competition, you must be 18 years of age or over and a named Synergy account holder.

3. Synergy must receive your completed entry form by midnight Tuesday 14 February 2012.

4. Employees, relatives and agents of Synergy and any related bodies are not eligible to enter.

5. The Competition commences on Monday 12 December 2011 and closes at midnight on Tuesday 14 February 2012.

6. The total prize pool value is $2,500 (including GST). Synergy will award a total of ten (10 ) prizes from this total prize pool with each prize consisting of 10 Hoyts double movie passes valid for 1 year from the date detailed therein and worth $250.

7. To enter, eligible customers must answer the following two questions correctly:
• Name the two (2) companies that form the proactive Future Energy Alliance partnership?
• What are the minimum and maximum star ratings under the standard star rating system?

8. Entry for a chance to win the Competition can be either via the Synergy website at synergy.net.au/win or via post:
Synergy, Hoyts Movie Passes Competition, GPO BOX K795, Perth WA 6842.

9. Customers entering by post must include the answers to the two questions, plus their name, Synergy bill account number, address and phone number. Customers entering via the Synergy website must provide the answers to the two questions, their name, Synergy bill account number, address and phone number in the fields provided.

10. The ten winners will be drawn by random selection at 12 pm on Tuesday 21 February 2012 at Synergy, Head Office, 228 Adelaide Terrace, Perth, WA 6000.

11. The winners will be notified by mail and/or telephone and their names and suburbs will be published on the Synergy website.

12. The prize must be claimed by the winners and delivered within six months of the draw date.

13. The prize must be taken “as offered” and cannot be varied, extended, transferred, exchanged or redeemed for cash.

14. If the stated prizes are unavailable for any reason, Synergy reserves the right to offer substitute prizes of equivalent value.

15. Any additional products or services not included in the prize, but required by a winner, will need to be arranged and paid for by that winner.

16. Each competition winner consents to Synergy using his or her name, suburb and photograph for publicity purposes.

17. Synergy is not liable for any loss, damage or injury arising out of, or in any way connected with this promotion and/or the prize.

18. Synergy accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or ineligible applications, claims or correspondence whether due to error, omission, alteration, tampering, theft, deletion, destruction, transmission, interruption, communications failure or otherwise. Synergy has no control over the internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.

19. If for any reason any aspect of the Competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs tampering, unauthorised intervention, fraud, technical failures, or any cause beyond the control of Synergy which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, Synergy in its sole discretion may cancel, terminate, modify or suspend the Competition, or invalidate any affected entries, subject to the approval of Gaming and Wagering Commission (WA) or other relevant authorities.

20. Synergy and its associated agencies and companies is not liable to any winner or any other person (including but not limited to liability for negligence) for any loss, expense, damage or injury which is suffered or sustained (whether or not arising from any person’s negligence) in connection with all or any of the promotion, the Competition or accepting or using any of the prizes, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

21. Any queries or complaints regarding the prizes, including but not limited to: using or redeeming the prize, or the period within which the prizes must be used, must be directed to The Hoyts Corporation Pty Ltd (ABN 31 006 082 551) (Hoyts) directly and not to Synergy, and the prize winners must comply with the terms and conditions imposed by Hoyts in the use of the prizes as detailed on their website: www.hoyts.com.au

22. Nothing in these terms and conditions excludes, restricts or modifies the rights of any person or entity as a “consumer” under the Australian Consumer Law (or any other statutory rights) to the extent the law does not allow them to be excluded, restricted or modified.

23. All entries will be the property of Synergy. The information entrants provide will be used by Synergy for the purpose of and relating to conducting the Competition and otherwise in accordance with Synergy’s Privacy Policy (available at www.synergy.net.au). Without limitation, Synergy may disclose entrants’ personal information to relevant suppliers, contractors and agents for or in relation to any of those purposes and to State and Territory regulatory bodies and winners’ names may be published, as required, under the relevant legislation. Synergy’s marketing activities are subject to the National Privacy Principles in the Privacy Act 1988 (Cth).

24. Synergy may cancel, withdraw or change the duration of the Competition at any time with the prior written approval of the Gaming and Wagering Commission (WA).

25. These terms and conditions are governed by and to be interpreted in accordance with the laws of Western Australia.
