Synergy Connect Program and Prize Draw

Terms and Conditions 

Being a Synergy Connect member. 
1. ‘Synergy Connect’ is an insights community hosted by Synergy (ABN 58 673 830 106) where Synergy Connect members are invited to participate in research activities such as surveys, interviews, online discussions and focus groups. 
2. To become a Synergy Connect member (Member): 
a. You must be aged 18 years and above; and reside in Western Australia; 
b. You must receive an invitation to join Synergy Connect; 
c. You must accept the invitation to join Synergy Connect, which means accepting these terms and conditions (Terms); and
d. You must be accepted as a Member by Synergy. 
3. Membership numbers are limited. Synergy may therefore accept or reject a membership request in its sole discretion.   Synergy may also withdraw a membership in its sole discretion if Synergy considers the Member is not participating genuinely or acting consistent with the purpose of the Membership.

How we’ll engage with you. 
4. From time to time, Members will be invited to take part in online surveys and other research activities such as interviews and focus groups. 
5. Participation in the research is completely voluntary. 
6. Members can also expect to receive newsletters and updates relating to Synergy Connect and their membership. 

Rewards for participation.
7. We value the feedback and contribution by our members. Rewards for participation will differ depending on the activity. This typically includes entries into prize draws for easier tasks and a guaranteed incentive for more engaging tasks (such as group discussions and interviews). The type of reward will always be outlined in any invitations to participate. Further terms and conditions may apply to the reward which, if they do, will be notified as part of any invitation to participate.
8. Members who participate in an online survey will automatically gain an entry into the “Synergy Connect prize draw” (Competition), as set out in Table 1. 
9. The Competition commences at 12:00am (AWST) on 11 September 2023 and closes at 11:59pm (AWST) on 30 June 2024 (Competition Period).  
10. Each prize consists of a $100 GiftPay e-Gift Card (Prize). There will be 50 prize winners in total and the total prize pool value is $5,000 (GST inc.). 
11. Each survey completion will result in one entry. The more surveys completed by an individual Member, the more entries they will gain in the Prize draw. Each entry will only be eligible for the next Prize Draw throughout the Competition Period.  For example, if a Member completes three surveys in October, the Member will have three entries in Prize draw 1.  However, the entries will not carry over for Prize draw 2. 
12. Prize winners will be chosen using a random electronic selection method. 
13. Prize draws will be conducted every two months. There will be a total of five prize draws for the duration of the Competition Period. Prize draws will take place at Synergy, 219 St Georges Terrace, Perth.

14. Synergy will notify winners of the Prizes via email. To redeem the prize, the winner must respond to the email from Synergy, confirming their full name. A winner will forfeit the Prize if the winner does not respond within 14 days. If a winner forfeits the Prize it will be randomly awarded to another Member who submits an eligible entry during the Competition Period.

The information we collect. 
15. When signing up to Synergy Connect, you will be required to complete a registration survey which gathers information about yourself. 
a. Personal information collected includes your name, email address and year of birth (at a minimum). 
b. Other general information we may collect include your gender identity, education, home ownership status, household income bracket and your general interests. We respect our members’ preferences and will endeavour to make these questions optional where possible. 
16. By signing up and being accepted as a Member by Synergy, you consent to providing us with this information.  We will collect and use any information you provide in accordance with Synergy’s Privacy Policy and Collection of Information Statement (available at synergy.net.au). If you do not want to provide the information or for us to use the information as set out in our Privacy Policy and Collection of Information Statement then you should not become a Member.  
17. Synergy engages Qualtrics LLC (Qualtrics) to provide platform services in respect of Synergy Connect as part of these services and Qualtrics stores information on Synergy's behalf.  Synergy only discloses information to Qualtrics in accordance with Synergy's Privacy Policy and Collection of Information Statement and the Australian Privacy Principles.

Ending your Synergy Connect membership. 
18. Members can opt out of Synergy Connect at any time. 
19. Opting out means a Member will no longer be sent invitations to participate in research conducted as part of Synergy Connect. 
20. Options to opt out include: 
a. Sending an email request to info@survey.synergy.net.au 
b. Clicking on the "Unsubscribe" link in the footer of email communications by Synergy Connect; and following the relevant prompts. 

General competition terms. 
Lastly, there are further Terms relating to the Prizes and the prize draw. 
21. Prizes must be taken “as offered” and cannot be varied, extended, transferred, exchanged or redeemed as cash or an upfront credit. 
22. If a Prize is unavailable for any reason, Synergy reserves the right to offer a substitute prize of equivalent value.  
23. If there is any expiry date by which the Prize must be used, Synergy will not be responsible if the Prize expires as a result of not being used or redeemed prior to that expiry date.   
24. The Prize may be subject to additional terms and conditions from the supplier which will be notified to the winner when the Prize is provided to the winner. 
25. All Members agree to participate and co-operate as required in editorial and promotional activities relating to the Competition, including but not limited to being interviewed and photographed.  The winner consents to Synergy using their name, likeness, image and voice (including photograph, film and recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting the Competition (including any outcome), Synergy and the products or services or both supplied by Synergy.  The winner agrees they will not, and will ensure that their companions do not participate in editorial and promotional activities with the Competition  any media or other organisation without Synergy’s prior consent.
26. Synergy accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or ineligible entries, applications, claims or correspondence whether due to error, omission, alteration, tampering, theft, deletion, destruction, transmission, interruption, communications failure or otherwise.  Synergy has no control over the postal system, internet, telecommunications networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. 
27. If for any reason any aspect of the Competition is not capable of running as planned, including by reason of infection by computer virus, telecommunications networks failure, bugs tampering, unauthorised intervention, fraud, technical failures, or any cause beyond the control of Synergy which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Competition, Synergy in its sole discretion may cancel, terminate, modify or suspend the Competition, or invalidate any affected entries, subject to the approval of Gaming and Wagering Commission (WA) or other relevant authorities, if and only to the extent required. 
28. None of Synergy and its associated agencies are liable to any winner or any other person in any way (including but not limited to liability for negligence) for any loss, expense, damage or injury which is suffered or sustained (whether or not arising from any negligence) in connection with all or any of the Survey, the Competition or acceptance, transportation, delivery or use of the Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum liability allowable by law). 
29. Nothing in these Terms excludes, restricts or modifies the rights of any person or entity as a “consumer” under the Australian Consumer Law (or any other statutory rights) to the extent the law does not allow them to be excluded, restricted or modified.  
30. All entries will be the property of Synergy. The information entrants provide will be used by Synergy for the purpose of and relating to conducting the Competition and otherwise in accordance with Synergy’s Privacy Policy and Collection of Information Statement (available at synergy.net.au). Without limitation, Synergy may disclose entrants’ personal information to relevant suppliers, contractors and agents for or in relation to any of those purposes and to State and Territory regulatory bodies and winners’ names may be published, as required, under the relevant legislation and as set out in these Terms. Synergy complies with the Australian Privacy Principles in the Privacy Act 1988 (Cth) in respect of its marketing activities. 
31. Synergy may cancel, withdraw or change the duration of the Competition at any time with the prior written approval of the Gaming and Wagering Commission (WA), if and only to the extent required. 
32. In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
33. These Terms are governed by and to be interpreted in accordance with the laws of Western Australia.
